Welcome to Kelpies Products, The Bench and Metal Factory. By placing an order with us, you agree to the following terms and conditions. 1.1 These Terms and Conditions ("Terms") apply to all purchases of custom, bespoke, and personalized garden metal benches from Kelpies Products, The Bench and Metal Factory ("we," "us," "our").
1.2 These Terms form a binding agreement between us and the person or entity purchasing products from us ("you," "your").
1.3 We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website, and it is your responsibility to review the Terms periodically.
2. Product Specifications and Customization
2.1 Our products are custom-made according to the specifications provided by you. Please review your order details carefully before confirming, as we cannot accept responsibility for any errors in the customization instructions provided.
2.2 We strive to represent product colors and finishes accurately, but variations may occur due to screen display differences or materials used. Any such variations are not grounds for returns or exchanges.
3. Ordering and Payment
3.1 Orders are considered final once payment is received. We accept major credit and debit cards as well as other payment methods specified at checkout.
3.2 Prices for our products are subject to change without notice, but any changes will not affect orders already confirmed.
3.3 Custom products require full payment upfront. For bespoke orders involving special designs, additional fees may apply.
4. Delivery and Shipping
4.1 Estimated delivery times vary based on customization complexity and shipping destination. We aim to provide an accurate delivery date upon order confirmation.
4.2 We are not responsible for delays due to unforeseen circumstances or factors outside our control, including customs delays or natural events.
4.3 Risk of damage or loss passes to you upon delivery of the product. You are responsible for providing a secure delivery location.
5. Returns and Cancellations
5.1 As our products are custom-made to your specifications, returns and cancellations are not accepted once production begins. However, we may consider changes or cancellations on a case-by-case basis if notified promptly.
5.2 In the event of a defect in material or workmanship, please contact us within 7 days of receipt. We will repair or replace the item at our discretion, but are not liable for minor imperfections or normal wear.
6. Intellectual Property
6.1 All design concepts, artwork, and images associated with our products are owned by Kelpies Products, The Bench and Metal Factory and are protected by intellectual property laws. You may not use, reproduce, or distribute any of these materials without our express written consent.
7. Limitation of Liability
7.1 To the fullest extent permitted by law, Kelpies Products, The Bench and Metal Factory disclaims all warranties, express or implied, regarding your purchase, including any implied warranties of merchantability and fitness for a particular purpose.
7.2 In no event shall we be liable for any indirect, special, incidental, or consequential damages arising from your use of our products.
8. Governing Law
8.1 These Terms are governed by and construed in accordance with the laws of Scotland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Scotland.
